These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Go Yazilim Danismanlik A.S., a company registered in the Republic of Turkey, operating under the brand TechnologyChecker.io ("we," "us," "our," or the "Company"). These Terms govern your access to and use of the website at technologychecker.io, the web application at app.technologychecker.io, our APIs, and all related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service.

Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If you are accessing or using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" refer to both you as an individual and the entity you represent.

Description of Service

TechnologyChecker.io provides a technology intelligence platform that enables sales, marketing, and research professionals to discover and analyze the technology stacks of websites and organizations. The Service includes:

Core Features

Technology Detection: Identification of 40,000+ technologies, frameworks, CMS platforms, analytics tools, payment processors, and other software used by publicly accessible websites, detected through HTTP headers, JavaScript libraries, DNS records, HTML patterns, and other publicly available signals
Contact Intelligence: Verified business contact information associated with domains and organizations, sourced from publicly available data, company registries, and public professional profiles
Historical Data: 20+ years of historical records covering technology adoption, migrations, and trends across monitored domains
Real-Time Alerts (Signals): Customizable notifications triggered when monitored domains adopt, remove, or change technologies
Lead Lists: Custom lists of companies matching specific technographic, firmographic, and geographic criteria
API Access: Programmatic access to technology intelligence data via RESTful API
Bulk Operations: Batch processing of domain lookups, data enrichment, and CSV/Excel exports
CRM Integrations: Connections with third-party CRM platforms for data synchronization

Data Sources

All technology detection and business intelligence data is derived from publicly available sources. We do not access private, authenticated, or password-protected content. Our web crawlers respect robots.txt directives and operate in compliance with applicable laws.

Account Registration and Security

Account Creation

To access certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete registration information
Maintain and promptly update your account information to keep it accurate
Maintain the security and confidentiality of your login credentials
Accept full responsibility for all activities that occur under your account
Notify us immediately at hello@technologychecker.io of any unauthorized use of your account or any other breach of security
Use only one account per individual (unless authorized for team accounts on paid plans)

Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We strongly recommend using a unique, strong password and enabling additional security features where available. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

Account Suspension and Termination

We reserve the right to suspend or terminate accounts that:

Violate these Terms or any applicable law
Are reasonably believed to be involved in fraudulent or abusive activity
Engage in unauthorized automated access or scraping
Remain inactive for more than 12 consecutive months (free accounts only)
Provide false or misleading registration information

Subscription Plans, Pricing, and Payment

Free Plan

The free plan provides limited access to the Service with a monthly allocation of 100 technology lookups. Free plan features, limits, and availability are subject to change at our discretion with reasonable notice. The free plan is intended for individual evaluation purposes and may not be used for commercial-scale operations.

Paid Plans

Paid plans (currently Pro and Scale) provide enhanced access with higher usage limits and additional features as described on our Pricing page. Paid subscriptions are billed in advance on a monthly or annual basis, depending on the billing cycle you select at signup.

Payment Terms

All fees are quoted and charged in United States Dollars (USD) unless otherwise agreed in writing
Payment is securely processed through our third-party payment provider, Stripe Inc. (PCI DSS Level 1 certified)
By subscribing to a paid plan, you authorize us to charge your selected payment method for all applicable fees, including recurring subscription charges
Fees are exclusive of applicable taxes (VAT, sales tax, etc.), which will be added where required by law
We reserve the right to change our pricing with at least 30 days' notice. Price changes apply to new billing cycles only and will not affect your current billing period.

Refund Policy

Subscription fees are generally non-refundable. However:

If you cancel within 14 days of your initial paid subscription and have not used more than 10% of your monthly allocation, you may request a full refund by contacting hello@technologychecker.io
Refunds for service outages exceeding 24 consecutive hours will be considered on a case-by-case basis
Refunds required by applicable consumer protection laws will be honored

Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. Upon cancellation:

You will retain access to paid features until the end of your current billing period
Your account will automatically downgrade to the free plan
Data associated with paid-plan features (lead lists, signals, etc.) will be retained for 90 days, after which it may be deleted
Annual subscriptions are non-refundable for the remaining months after cancellation

Failed Payments

If a payment fails, we will attempt to charge your payment method up to three times over a 10-day period. If payment cannot be collected, your account may be downgraded to the free plan or suspended until the outstanding balance is resolved.

Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following activities are strictly prohibited:

General Restrictions

Using the Service in violation of any applicable local, national, or international law or regulation, including but not limited to data protection laws (GDPR, KVKK, CCPA), anti-spam legislation (CAN-SPAM, CASL), and telecommunications regulations
Using the Service to send unsolicited commercial communications (spam), including bulk emails, cold calls, or messages to contacts obtained through the Service without a legitimate legal basis
Using contact data obtained through the Service for purposes that violate applicable data protection laws, including processing personal data without an appropriate legal basis
Reselling, redistributing, sublicensing, or otherwise making the Service or its data available to third parties without our prior written consent
Using the Service or its data to build a competing product, service, or database

Technical Restrictions

Scraping, crawling, or otherwise automatically extracting data from the Service beyond what is permitted through the API
Attempting to reverse engineer, decompile, disassemble, or derive the source code of any part of the Service
Interfering with, disrupting, or attempting to compromise the integrity, security, or performance of the Service or its underlying infrastructure
Attempting to gain unauthorized access to any systems, accounts, or data not intended for you
Circumventing or attempting to circumvent rate limits, usage quotas, authentication mechanisms, or other technical restrictions
Introducing malicious code, viruses, worms, trojans, or other harmful software
Using automated tools, bots, or scripts to access the Service except through our official API

Content and Conduct Restrictions

Using the Service to harass, threaten, intimidate, stalk, or harm any person or entity
Impersonating any person or entity, or falsely representing your affiliation with any person or entity
Uploading or transmitting content that is defamatory, obscene, fraudulent, or otherwise objectionable
Using the Service for any purpose that could damage, disable, or impair the Service or interfere with other users' access

We reserve the right to investigate suspected violations and take appropriate action, including account suspension, termination, and reporting to law enforcement authorities.

API Terms of Use

API Access and Authentication

Access to our API is provided subject to the rate limits, usage quotas, and feature restrictions of your subscription plan. API keys are unique to your account and are strictly confidential. You must:

Keep API keys secure and never share them publicly (e.g., in client-side code, public repositories, or forums)
Immediately regenerate and replace any API key that may have been compromised
Use API keys only for authorized purposes consistent with your subscription plan

Rate Limits and Fair Use

We enforce rate limits to ensure fair use and platform stability for all users. Current rate limits are documented in our API documentation and vary by subscription plan. Exceeding rate limits may result in:

Temporary throttling of API requests (HTTP 429 responses)
Temporary suspension of API access
Permanent restriction or termination for repeated or intentional abuse

API Data Usage

Data retrieved through the API may be used in accordance with your subscription plan and these Terms. Specifically:

You may integrate API data into your internal business applications, CRM systems, and workflows
You may not redistribute raw API data to third parties or make it publicly accessible without our written consent
You may not use API data to create a competing technology detection service or database
You must comply with all applicable data protection laws when processing personal data obtained through the API
Cached data must be refreshed at intervals consistent with your subscription plan

API Changes and Deprecation

We may update, modify, or deprecate API endpoints with reasonable notice. We will provide at least 90 days' notice before removing or making breaking changes to stable API endpoints. Beta or experimental endpoints may be changed without notice.

Intellectual Property Rights

Our Intellectual Property

The Service, including its design, user interface, features, functionality, algorithms, detection methodologies, software code, documentation, graphics, logos, trademarks, and all underlying technology, is the exclusive property of Go Yazilim Danismanlik A.S. and is protected by Turkish and international intellectual property laws, including copyright, trademark, patent, and trade secret laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your subscription. This license does not include the right to:

Modify, adapt, or create derivative works based on the Service
Sublicense, lease, rent, or lend the Service to any third party
Remove, alter, or obscure any proprietary notices or branding
Copy or reproduce any part of the Service except as necessary for normal use

Your Content

You retain all ownership rights in any content, data, or materials you upload, submit, or create through the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, process, store, and display Your Content solely as necessary to provide, maintain, and improve the Service.

Technology Detection Data

Technology detection results, company intelligence data, historical records, and other data generated or provided by the Service remain the intellectual property of Go Yazilim Danismanlik A.S. Your subscription grants you a license to use this data in accordance with your plan's terms, but does not transfer ownership.

Feedback

If you provide feedback, suggestions, ideas, or feature requests about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, implement, modify, and incorporate such Feedback into the Service without any obligation or compensation to you.

Data Accuracy, Warranties, and Disclaimers

Data Accuracy

While we employ sophisticated detection algorithms and regularly update our technology signatures, we make no representations or warranties regarding:

The completeness, accuracy, or timeliness of technology detection results — detection is based on publicly observable signals and may not reflect the complete technology stack
The deliverability, accuracy, or currency of contact information — business contacts change frequently and data may become stale
The timeliness or delivery of real-time alerts and notifications — alerts depend on crawl frequency and system availability
The availability of historical data for any specific domain, technology, or time period
The accuracy of derived metrics such as market share percentages, company size estimates, or industry classifications

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that defects will be corrected or that the Service will meet your specific requirements.

Service Availability

We aim to maintain high Service availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to scheduled maintenance (announced in advance where possible), emergency maintenance, force majeure events, or circumstances beyond our reasonable control. Our target uptime is 99.9% measured on a monthly basis, excluding scheduled maintenance windows.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Exclusion of Indirect Damages: Go Yazilim Danismanlik A.S., its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, regardless of the cause of action or theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
Cap on Liability: Our total aggregate liability for any and all claims arising from or related to your use of the Service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
Basis of the Bargain: The limitations and exclusions in this section reflect a reasonable allocation of risk between the parties and are a fundamental element of the basis of the bargain between us. The Service would not be provided without these limitations.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify, defend, and hold harmless Go Yazilim Danismanlik A.S., its directors, officers, employees, agents, and affiliates from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your access to or use of the Service
Your violation of these Terms or any applicable law or regulation
Your violation of any third-party rights, including intellectual property, privacy, or data protection rights
Your use, processing, or distribution of data obtained through the Service
Any content or data you submit, upload, or transmit through the Service
Any unauthorized use of your account, whether by you or any third party

We will provide you with prompt notice of any such claim and will cooperate with your defense. We reserve the right, at your expense, to assume the exclusive defense of any claim for which you are required to indemnify us.

Termination

Termination by You

You may terminate your account at any time by canceling your subscription through your account settings and requesting account deletion by contacting hello@technologychecker.io.

Termination by Us

We may terminate or suspend your access to the Service immediately, with or without notice, for cause, including but not limited to:

Material breach of these Terms
Violation of applicable laws or regulations
Fraudulent, abusive, or illegal activity
Non-payment of fees after reasonable notice and opportunity to cure
Requests from law enforcement or government agencies
Extended periods of inactivity (free accounts: 12+ months)

Effects of Termination

Upon termination of your account:

Your right to access and use the Service will immediately cease
Any outstanding fees become immediately due and payable
We will retain your personal data in accordance with our Privacy Policy and applicable data retention requirements
Lead lists, signals, saved searches, and other user-created data will be deleted after a 90-day grace period
You may request an export of your data before or within 30 days after termination
The following sections survive termination: Intellectual Property Rights, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive

Modifications to the Service and Terms

Service Changes

We continuously improve and evolve the Service. We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time. For material changes that negatively affect your use:

We will provide at least 30 days' advance notice via email or in-app notification
Annual subscribers may request a pro-rated refund if a material feature they rely on is removed

Terms Changes

We reserve the right to modify these Terms at any time. When we make material changes:

We will update the "Last Updated" date at the top of this page
We will notify registered users via email at least 14 days before the changes take effect
We will display a prominent notice on our website

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your account.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service:

Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiation. You may contact us at hello@technologychecker.io to initiate this process.
Mediation: If informal resolution is unsuccessful within 30 days, either party may submit the dispute to mediation administered by a mutually agreed-upon mediator in Ankara, Turkey.
Jurisdiction: If mediation is unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the courts of Ankara, Republic of Turkey.

European Union Residents

If you are a consumer resident in the European Union, you may also be entitled to submit a dispute through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Nothing in these Terms affects your statutory rights as a consumer under applicable EU law.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any plan-specific terms presented at the time of subscription, constitute the entire agreement between you and Go Yazilim Danismanlik A.S. regarding the Service. These Terms supersede all prior agreements, representations, and understandings.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Go Yazilim Danismanlik A.S.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets, provided that the assignee agrees to be bound by these Terms.

Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.

Notices

All notices from us to you will be sent to the email address associated with your account. Notices from you to us should be sent to hello@technologychecker.io or to our registered address. Notices are deemed received when sent via email (upon delivery confirmation) or 5 business days after mailing.

No Third-Party Beneficiaries

These Terms are between you and Go Yazilim Danismanlik A.S. only. No third party has any rights to enforce any provision of these Terms.
